ANKARA – The AYM application made against the delivery of the fax sent by Ahmet Akkurt, a prisoner in Bolu Type F High Security Prison, to PKK leader Abdullah Öcalan for information about his health after the coup was declared 'undesirable'. The fax was declared undesirable on grounds that 'It was written to keep the motivation high.'
The fax Ahmet Akkurt, a prisoner from Bolu Type F High Security Closed Prison sent to PKK Leader Abdullah Öcalan on July 15, 2016 for information about his health after the coup was declared 'undesirable' and was not delivered to re recipient. Thereupon, on September 30, 2016, Akkurt, who made an individual application to the Constitutional Court (AYM) regarding "Violation of the Freedom of Communication", was answered. Constitutional Court (AYM) dismissed the application, stating that it was manifestly ill-founded.
Bolu Prison Disciplinary Board decided not to deliver the fax in question and six more similar fax sent by the same person on July 25, 2016 on grounds that the fax content might 'lead the persons and the institutions to panic' and that it has offensive content about the Republic of Turkey'.
The objection Akkurt made to the Bolu Enforcement Judge on August 10, 2016 against the disciplinary board was also rejected on grounds that 'the fax is a communication tool for the members of the organization'. Upon the refusal of his objection, the objection made by Akkurt to the Bolu Assize Court was dismissed on 26 August 2016, following the decision of the Bolu Execution Judge in accordance with the procedure and the law.
