Constitutional Court rejects HDP's request for their accounts to be blocked

ANKARA - The Constitutional Court rejected the request of the Chief Public Prosecutor's Office of the Supreme Court of Appeals to block the HDP's accounts.
 
The Constitutional Court (AYM) discussed the demand for the Peoples' Democratic Party (HDP) treasury aid to be blocked on the grounds that the Chief Public Prosecutor's Office of the Supreme Court "did not participate in the elections". The General Assembly of the Constitutional Court, as a precaution, blocked the aid amounting to 400 million 228 thousand 667 TL, which was paid to HDP by the Ministry of Treasury and Finance in accordance with the sixth paragraph of the additional article 1 of the Political Parties Law, and the portion spent from the state aid came from the party and from those who made the expenditure. It has decided on the request to be collected and recorded as income to the Treasury.
 
UNANIMOUS VERDICT
 
The Constitutional Court ruled that there is no room for a decision regarding the demand for the HDP to be blocked in its General Assembly meeting.
 
THE CONSTITUTIONAL COURT HAS PREVIOUSLY REJECTED
 
The Office of the Chief Public Prosecutor of the Court of Cassation had previously requested that the accounts of HDP for which treasury aid was paid be blocked, but the Constitutional Court, by majority of votes, decided to reject this request of the Office of the Chief Public Prosecutor of the Court of Cassation. The Chief Prosecutor of the Court of Cassation Bekir Şahin filed a lawsuit at the Constitutional Court for the closure of HDP on June 7, 2021, and the General Assembly of the Constitutional Court unanimously decided to accept the indictment on June 21, 2021. At Şahin's request, the Constitutional Court had temporarily blocked HDP's Treasury aid account. HDP objected to the decision taken by a majority of eight votes against seven. On March 9, the AYM discussed the HDP's objection and decided to lift the blockade with a majority of votes.
 
According to the Political Parties law, treasury aid is paid to all political parties in the years of general elections.
